Terms of Service
1. Agreement to these Terms
These Terms of Service (“Terms”) form a binding agreement between you and Resilient Kids (“Resilient Kids,” “we,” “us,” or “our”) and govern your access to and use of the Resilient Kids mobile application and any related services (together, the “Service”).
- Legal entity: Resilient Kids LLC (a Delaware limited liability company)
- Contact: research@resilient.kids
- Address: 2810 N Church St #769322, Wilmington, DE 19802, USA
By creating an account, purchasing a subscription, or otherwise using the Service, you confirm that you have read, understood, and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract in your jurisdiction to use the Service. The Service is intended for adult caregivers (parents, guardians, grandparents, and other caring adults) raising children. Children may not create accounts or use the Service directly.
By using the Service, you represent that:
- You are 18 or older.
- You have the authority and, where applicable, the legal rights to enter any information you provide about a child in your care.
- Your use of the Service complies with all laws applicable to you.
3. Your account
To use most features you must create an account. You agree to:
- Provide accurate information and keep it up to date.
- Keep your password and sign-in credentials confidential.
- Notify us promptly at research@resilient.kids if you suspect unauthorized access to your account.
You are responsible for activity that occurs under your account. You may invite additional caregivers to your household using the invite codes the app generates. Everyone you invite becomes bound by these Terms when they sign in.
4. How the Service works
Resilient Kids delivers weekly, age-timed, evidence-informed guidance for adult caregivers raising a child. Each week, based on the child’s current age, the app surfaces:
- An article for the week.
- Suggested action items.
- Optional reflection prompts and achievements.
Some content is available without a subscription (“Free”). Other content and features require an active subscription (see Section 5).
Guidance, not advice. The content is educational and is not professional advice. See Section 9 for important disclaimers.
5. Subscriptions and billing
5.1 Plans
We offer the following subscription plans:
- App (Individual) — monthly or annual; for one caregiver account.
- Household — monthly or annual; for up to four caregiver accounts sharing one household.
Exact prices are shown in the app and may vary by region. Annual plans offer a discount compared to paying monthly — the savings are displayed on the plan picker.
5.2 Purchases through Apple App Store and Google Play
All subscriptions are sold and processed through the Apple App Store (on iOS) or Google Play (on Android). When you buy a subscription:
- Your payment is processed by Apple or Google according to their respective terms and privacy policies. We do not see your credit card number, bank details, or full billing address.
- Your subscription will auto-renew at the end of each billing period at the then-current price, unless you cancel at least 24 hours before the renewal date.
- You can manage or cancel your subscription at any time from your Apple ID settings or your Google Play account. Deleting the app does not cancel your subscription.
- Applicable taxes are collected by Apple or Google at purchase.
5.3 30-day money-back guarantee
If you purchase a subscription and decide within 30 days that the Service is not for you, contact us at research@resilient.kids with your purchase receipt and the email associated with your account and we will help you request a refund. Because purchases are processed by Apple or Google, refunds are issued through them; we cannot guarantee that Apple or Google will grant every refund request, but we will support you in making the request and, where we have discretion, will err on the side of making it right.
5.4 Price changes
We may change subscription prices for future billing periods. We will notify you in the app or by email at least 30 days before any price change takes effect on a renewing subscription. If you do not accept the new price, you can cancel before the change takes effect.
5.5 Free features and trials
We may offer free features, promotions, or trial periods. We reserve the right to modify or discontinue any free features or promotions at any time without notice.
6. Content and intellectual property
6.1 Our content
The Service and its contents — articles, text, graphics, logos, icons, design, and software — are the property of Resilient Kids or our licensors and are protected by copyright, trademark, and other laws.
We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, non-commercial use in accordance with these Terms. You may not:
- Copy, modify, distribute, sell, or lease any part of the Service or its content.
- Reverse-engineer, decompile, or attempt to extract the source code of the app, except to the extent permitted by applicable law.
- Use the Service to build a competing product.
- Remove or obscure any proprietary notices.
6.2 Your content
Some features let you save notes, reflections, or other information (“Your Content”). You retain all rights in Your Content. By saving Your Content in the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display Your Content solely to operate the Service for you (for example, to sync it across your devices or between caregivers in your household).
You are responsible for Your Content and represent that you have the rights to share it and that it does not violate these Terms or the law.
6.3 Feedback
If you send us ideas, suggestions, or feedback, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you.
7. Acceptable use
You agree not to:
- Use the Service for any illegal purpose or to violate any law.
- Upload content that is harassing, threatening, defamatory, obscene, or that infringes the rights of others.
- Interfere with or disrupt the Service or the servers and networks that host it.
- Attempt to gain unauthorized access to another user’s account or household.
- Use automated means (bots, scrapers) to access the Service, except as expressly permitted by us.
- Resell, sublicense, or commercially exploit the Service.
We may investigate and take appropriate action — including suspending or terminating your account — if we reasonably believe you have violated these Terms.
8. Third-party services
The Service relies on or integrates with third-party services, including Apple, Google, Supabase, RevenueCat, and Brevo. Your use of those services is also governed by their own terms and privacy policies. We are not responsible for the acts or omissions of third parties.
The Service may contain links to external websites or resources. We are not responsible for their content or practices.
9. Not medical, legal, or professional advice
Resilient Kids is an educational tool, not a substitute for professional advice. Content in the app is general guidance informed by research and clinical experience, but every child and every family is different.
- The Service does not provide medical, psychological, legal, educational, or other professional advice.
- The Service does not diagnose, treat, cure, or prevent any condition.
- If you have a concern about your child’s health, development, safety, or wellbeing, consult a qualified professional — such as your pediatrician, a licensed mental-health clinician, or your child’s teacher.
- If you believe your child or anyone else is in immediate danger, contact local emergency services.
Your reliance on any information provided through the Service is solely at your own risk.
10. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes what information we collect, how we use it, and what choices you have. By using the Service you agree to the practices described there.
11. Termination
11.1 By you
You can stop using the Service at any time. You can delete your account from Settings → Delete Account, or by emailing research@resilient.kids. Deleting your account cancels your in-app household membership. To stop subscription renewals you must also cancel the subscription in your Apple ID or Google Play settings.
11.2 By us
We may suspend or terminate your access to the Service, with or without notice, if:
- You materially breach these Terms.
- We are required to do so by law or to protect the rights or safety of others.
- We discontinue the Service (in which case we will provide reasonable advance notice where practical, and will honor any active paid subscription through the end of its current billing period or provide a prorated refund).
Sections that by their nature should survive termination — including Sections 6, 9, 12, 13, 14, and 16 — will survive.
12. Disclaimers
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranty arising out of course of dealing or usage of trade.
We do not warrant that the Service will be uninterrupted, secure, or error-free, that defects will be corrected, or that any content is accurate or reliable.
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In those jurisdictions, our warranties are limited to the minimum extent permitted by law.
13. Limitation of liability
To the maximum extent permitted by law, in no event will Resilient Kids, its affiliates, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of the Service — even if we have been advised of the possibility of such damages.
Our total aggregate liability for all claims arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) USD $50.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so some of the above limitations may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.
14. Indemnification
You agree to indemnify and hold harmless Resilient Kids and its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Service, (b) Your Content, (c) your violation of these Terms, or (d) your violation of any rights of another person or entity.
15. Changes to the Service and these Terms
We may modify the Service or these Terms from time to time. If we make material changes to these Terms, we will notify you in the app or by email before the changes take effect. Your continued use of the Service after the changes take effect constitutes your acceptance of the revised Terms. If you do not agree, you must stop using the Service.
16. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. You and we agree that any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in New Castle County, Delaware, and you consent to their personal jurisdiction and venue — except where applicable consumer-protection law gives you a non-waivable right to bring a claim in the courts of your home state, in which case that right is preserved.
17. Apple App Store additional terms
If you downloaded the app from the Apple App Store, the following additional terms apply, and in the event of a conflict with anything else in these Terms, these additional terms control:
- You acknowledge these Terms are between you and Resilient Kids, not with Apple, and Apple is not responsible for the app or its content.
- Your license to use the app is limited to use on an Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to furnish any maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
- Resilient Kids, not Apple, is responsible for addressing any claims relating to the app or your use of it, including product-liability claims, legal or regulatory non-compliance claims, and consumer-protection claims.
- Resilient Kids, not Apple, is responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim related to the app.
- You represent that you are not located in a country subject to a US Government embargo or designated by the US Government as a “terrorist supporting” country, and that you are not listed on any US Government list of prohibited or restricted parties.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
18. Google Play additional terms
If you downloaded the app from Google Play, you acknowledge that these Terms are between you and Resilient Kids only, and not with Google. Google is not responsible for the app or its content. Your use of the app must comply with the Google Play Terms of Service.
19. Miscellaneous
- Entire agreement. These Terms, together with our Privacy Policy and any additional terms you agree to when using specific features, are the entire agreement between you and us regarding the Service.
- Severability. If any provision of these Terms is held to be unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
- Assignment. You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Contact. Questions about these Terms? Email research@resilient.kids and include “Terms” in the subject line.
